Terms of Service for Incipor, the professional authoring app for macOS.

Please read these terms and conditions carefully before using Our Service.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
- Application refers to Incipor, the software program provided by the Company.
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to CPE Verm. GmbH, Straße der Jugend 18, 14974 Ludwigsfelde, Germany.
- Device means any device that can access the Service, such as a Mac computer, iPad, or iPhone.
- Service refers to the Application.
- Membership refers to the optional auto-renewing subscription offered through the Apple In-App Purchase system that unlocks paid features of the Application.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Acknowledgment
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 13. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.
License to Use Application
Subject to Your compliance with these Terms and Conditions, the Company grants You a limited, non-exclusive, non-transferable, revocable license to use the Application on Your personal Device(s) for Your personal or commercial writing.
You may not redistribute, reverse engineer, decompile, disassemble, or create derivative works based on the Application.
Membership and In-App Purchases
Incipor is distributed through the Mac App Store and offers an optional Membership with monthly and annual billing intervals. All payments are processed by Apple under the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement.
Membership subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel Your Membership at any time in Your Apple ID subscription settings — uninstalling the Application alone does not cancel the subscription.
If a Membership has previously been purchased and later lapses, You may continue to access the Application in a limited read-only mode for Your existing content. We reserve the right to change Membership pricing, add or remove features, or modify included services, consistent with Apple’s requirements for grandfathered subscriptions. All purchases are generally non-refundable, except as required by law or Apple’s refund policy.
AI Features
The Application may offer optional AI-assisted features. Two categories exist:
- On-device AI. Runs entirely on Your Mac using Apple’s mlx-swift framework. No prose, prompts, or metadata leave Your device when You use on-device AI.
- Cloud AI. When You opt in, prose or prompt text You explicitly choose to send is transmitted over TLS to our servers (models.incipor.com), which forward the request to Anthropic’s Claude API. Cloud AI is off by default.
You are responsible for the content You submit to AI features and for ensuring that the text You send does not contain material You are not authorized to share. The Company does not retain the text of cloud AI requests on its servers, but downstream providers (Anthropic) process the request under their own terms and privacy policies.
AI output is generated by statistical models and may contain inaccuracies, fabrications, or content that does not match Your intent. You are solely responsible for reviewing and editing any AI-generated output before including it in Your manuscript or publishing it.
Your Content
You retain all rights to the manuscripts, notes, characters, scenes, and any other content You create in Incipor. The Company does not claim any rights to Your work. Your writing is stored locally on Your Mac in the .book format and is not transmitted to us except in the narrow, opt-in case of the Cloud AI features described above.
You are responsible for Your content and for ensuring that You have the rights to any third-party material You include in Your manuscript.
Links to Other Websites and Third-Party Services
The Service may connect to third-party services that are not owned or controlled by the Company, including:
- Apple services (Mac App Store, iCloud, Apple Books publishing)
- Anthropic Claude API (reached via our servers, when You opt in to Cloud AI)
- Amazon Web Services (hosts our servers and the incipor.com marketing website)
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party services that You use.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of the Company. The Service is protected by copyright, trademark, and other laws. You retain all rights to the manuscripts and data You create or import into the Application. The Company does not claim any rights to Your content.
Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. You may terminate Your use of the Service at any time by uninstalling the Application. To cancel an active Membership, You must do so in Your Apple ID subscription settings — uninstalling alone does not cancel recurring billing. Your in-app purchases are not refundable if You choose to uninstall or stop using the Application.
Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. THE COMPANY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE CORRECTNESS OR USEFULNESS OF ANY AI-GENERATED OUTPUT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF MANUSCRIPTS, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You are solely responsible for maintaining regular backups of Your work. If the Company is found liable for any matter relating to the Service, Our maximum liability is limited to the amount You paid for in-app purchases in the twelve months preceding the claim, or $100 USD, whichever is less.
Dispute Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company at incipor@icloud.com. The Company will attempt to resolve disputes informally within thirty (30) days. If a dispute is not resolved within 30 days of submission, either party may bring a formal proceeding.
Any disputes arising out of or related to these Terms and Conditions or the Service shall be resolved through arbitration or small claims court, as applicable under the laws of Your jurisdiction.
For European Union (EU) Users
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which you are resident, including the 14-day cooling-off period for purchases where applicable under EU law.
For United States Users
If You are accessing the Service from the United States, You confirm that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that You are not listed on any U.S. Government list of prohibited or restricted parties.
Changes to These Terms and Conditions
We reserve the right to modify or replace these Terms at any time at Our sole discretion. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect through the Application or on the website.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Application and the Service.
Governing Law
These Terms and Your use of the Service shall be governed by the laws of the Federal Republic of Germany, excluding its conflicts of law rules. If You are a consumer resident in the European Union, You will benefit from any mandatory provisions of consumer protection law in the country in which You are resident.
